FORTUNE Analytics – Spreadsheet Products and Packages (“Spreadsheet”) Terms of Use

1. These Spreadsheet Terms of Use are additional to the Fortune Website/Application Terms of Use (collectively, these terms and Fortune Website/Application Terms of Use, “Terms”). In case of a conflict between sections with the same title in the Fortune Website/Application Terms of Use and in the below terms, the below terms control.

2. All sales are final.  No refunds or exchanges will be provided.

3. Your purchase of the Spreadsheet consists of a single downloaded file that may not be shared with anyone else via email, print or any other method. You may not rent, lease, loan, trade, sell/re-sell or otherwise monetize the Spreadsheet or access to the same.

4. Limited License.  You may access and view the Spreadsheet content on the Web Site on your computer or other device and access and use the Spreadsheet content solely for your internal corporate purposes, presentations to clients, and similar uses for which a fee is not charged by you or your company.

5. Any use of the Spreadsheet at your sole risk.

6. The look and feel, design, and organization of the Spreadsheet, and the compilation of the content, code, data, and materials in the Spreadsheet, including but not limited to any copyrights, trademark rights, patent rights, database rights, moral rights, sui generis rights, and other intellectual property and proprietary rights therein are the property of Fortune Media (USA) Corporation or one of its affiliates.

7. You may not use the Spreadsheet in violation of any applicable law or the Terms.

8. Except as set forth in section 4 above, any commercial or promotional distribution, publishing, or exploitation of the Spreadsheet, or any content, code, data, or materials on the Spreadsheet, is strictly prohibited unless you have received the express prior written permission from our authorized personnel or the otherwise applicable rights holder. Other than as expressly allowed herein, you may not download, post, display, publish, copy, reproduce, distribute, transmit, modify, perform, broadcast, transfer, create derivative works from, sell or otherwise exploit any content, code, data, or materials in the Spreadsheet. You further agree that you may not alter, edit, delete, remove, otherwise change the meaning or appearance of, or repurpose any of the content, code, data, or other materials on or available through the Spreadsheet, including, without limitation, the alteration or removal of any trademarks, trade names, logos, service marks, or any other proprietary content or proprietary rights notices. You acknowledge that you do not acquire any ownership rights by downloading or otherwise using the Spreadsheet.  If you make other use of Spreadsheet, content, code, data, or materials therein, except as otherwise provided above, you may violate copyright and other laws of the United States and/or other countries, as well as applicable state laws, and may be subject to liability for such unauthorized use.
