Even before the Supreme Court overturned Roe v. Wade in June, more than half of U.S. abortions were so-called medication abortions, in which women terminate their pregnancies by swallowing pills rather than undergoing surgical procedures. Now these pills are more important than ever—and the companies that make them are on the front lines of preserving women's access to reproductive health care. As states pass laws to ban all types of abortion, including those induced by medication, privately held GenBioPro is waging a public battle to help safeguard women's reproductive rights (and its own business). The Las Vegas–based company’s goal is to have a judge rule that the FDA’s regulations around mifepristone—which is federally approved to terminate pregnancies of up to 10 weeks—preempt state laws that restrict or fully ban the pill’s use. GenBioPro recently dropped a lawsuit challenging Mississippi’s abortion restrictions, but has said that it intends to bring cases in other courts. “We are committed to using the law to remove unnecessary barriers for patients and providers and we look forward to making an announcement soon about our next steps,” a company spokesperson told Fortune in September.
